Camera Surveillance Regulations

1. Nature of the Camera Surveillance

1.1. The NXT Fit B.V. uses camera surveillance for the purposes of:

• access control of buildings and premises of The NXT Fit B.V.
• monitoring of goods present in buildings or on premises of The NXT Fit B.V.,
• prevention and recording of nuisance such as vandalism,
• supervision of staff workplaces at The NXT Fit B.V.,
• prevention and recording of criminal acts by third parties (such as burglary, theft or vandalism), and everything directly related to this.

1.2. The recorded images may be reviewed at any time.

1.3. Camera surveillance is announced by means of signs at the borders of the area covered by the cameras, by clearly placed screens showing live camera images, by the cameras being clearly visible, by a notice on the bulletin board at The NXT Fit B.V., by letter to anyone who may be filmed, and in any other clearly recognizable manner if the situation requires it.

2. Hidden Cameras

2.1. No hidden cameras are used.

3. Execution of Camera Surveillance

3.1. In practice, camera surveillance is carried out by The NXT Fit B.V.. The NXT Fit B.V. remains at all times ultimately responsible for the execution of the camera surveillance.

4. Retention Period of Images

4.1. After recording, the images are stored for five working days with a view to use for the purposes mentioned under "Nature of the Camera Surveillance".

4.2. If the images show an incident concerning the matters mentioned under "Nature of the Camera Surveillance", these images may be kept for longer until the incident has been resolved.

4.3. After the expiry of this period or the resolution of an incident, the images are deleted by overwriting them with a new recording.

4.4. At the request of a person who has been captured on camera, these images will be deleted if there is no longer any necessity under this regulation to retain the images.

5. Access and Security of Images

5.1. The NXT Fit B.V. has taken adequate measures to secure against unauthorized access to or misuse of stored camera images.

5.2. The room where the images are stored is physically secured against access by unauthorized persons (key, pass, etc.). The images are stored on a separate, closed system and are not accessible via the network to anyone other than The NXT Fit B.V.. Persons authorized to view the images are explicitly bound to confidentiality. Access to the images is password-protected. Access to images is only permitted by two people at the same time ("four-eyes principle").

6. Access and Copies of Camera Images

6.1. A person who has been captured on camera can gain access to images in which they are recognizable by requesting this on location from The NXT Fit B.V..

6.2. A person who has been captured on camera can obtain a copy of these images by submitting a written request to The NXT Fit B.V..

6.3. A request for access or a copy requires identification and a clear indication of the time period during which the person suspects they were filmed.

6.4. A request may be refused if it is excessive or made in a very short time after a previous request.

6.5. No costs are charged for handling access requests and providing a copy. Administrative costs may be charged for additional copies.

7. Provision of Camera Images

7.1. Recorded camera images are only provided to the Justice Department when a legally issued order from a Public Prosecutor has been received, or when another legal regulation obliges The NXT Fit B.V. to do so.

7.2. If the images contain evidence of criminal offences, The NXT Fit B.V. may decide to file a report and voluntarily hand over the camera images to the competent authorities as evidence.

7.3. No access is provided to private parties, except when they are themselves in the images (see 'Access and copies' above).

8. Complaints and Questions

8.1. Questions or complaints about the use of the camera system and the behaviour of the employees involved can be submitted to The NXT Fit B.V. itself. The contact details are: info@thenxtfit.nl

8.2. A response will be given no later than four weeks after receipt of the complaint.

8.3. In cases not provided for in this regulation, The NXT Fit B.V. will decide.
