3.1. These general terms and conditions apply to every Offer and to all Agreements.
3.2. These general terms and conditions will be made available to the Customer no later than before concluding the Agreement.
3.3. The NXT Fit reserves the right to adjust and/or change these general terms and conditions at any time. These amended general terms and conditions will apply to every Offer and all purchases of Products after their publication on the Website or Reception.
3.4. The Customer's own purchase conditions cannot be opposed to The NXT Fit.
4.1. The Agreement is concluded from the moment the Customer has accepted the Offer and the general terms and conditions. The purchase of an access ticket or a subscription implies acceptance of the Regulations that apply to all visitors of The NXT Fit, as well as these general terms and conditions.
4.2. This Offer is reserved for natural persons (of legal age or at least 16 years old) and legal entities.
4.3. The Agreement and the general terms and conditions remain in force until all obligations, in particular the payment obligations, have been fulfilled.
5.1. The prices of the Products are as stated on the Website or Reception at the time the Customer places an order.
5.2. All prices are inclusive of VAT and are expressed in Euros, unless expressly stated otherwise on the quotation, order confirmation and/or invoice.
5.3. All stated prices, rates, access tickets and/or subscription prices can always be changed. These price changes and their effective date are made known on the Website.
6.1. The Customer can pay for the Products via the payment methods described on the Website via The NXT Fit's payment provider or at the Reception.
6.2. The Customer must pay when placing the order.
6.3. When purchasing dated access tickets via the Website, the right of withdrawal does not apply and these tickets are not refunded. The Customer can reschedule the chosen time slot to a later available time slot.
6.4. In case of a purchase on invoice by a company in the context of a group visit, the invoice must be paid no later than within 15 days. Part of the amount will also have to be paid as an advance when ordering the access tickets. If the Customer does not pay on time, the invoice is immediately due and the Customer owes interest as legally determined due to the delay from the invoice date.
7.1. Access tickets and subscriptions are strictly personal and can under no circumstances be lent or transferred. It is strictly forbidden to reproduce, duplicate or forge an access ticket or subscription in any way.
7.2. Lending an access ticket to a third party, as well as using and attempting to use an irregular access ticket, in addition to the fact that this may be prosecuted criminally, will immediately lead to the confiscation of the access ticket, without possibility of refund and without prejudice to compensation for all damages suffered.
7.3. The NXT Fit disclaims all responsibility in case of unlawful use of an access ticket after loss or theft thereof, if this loss or theft was not reported to her in advance.
7.4. Access tickets are only valid for the pre-reserved times. If the Customer enters The NXT Fit location more than 15 minutes later than the reserved time slot, The NXT Fit does not provide an extension of the duration of the access ticket.
7.5. The NXT Fit always has the right to change the opening hours of The NXT Fit Location without this giving rise to any right for the Customer to compensation or refund of a purchased access ticket or subscription.
8.1. After purchasing his/her access ticket, the Customer is invited to create a The NXT Fit account. This account can also be created on-site before the Customer enters the location.
8.2. Creating an account is required to be able to enter The NXT Fit.
9.1. The Customer acknowledges that by purchasing an access ticket to The NXT Fit location and entering The NXT Fit, he/she is also bound to comply with the applicable Regulations during his/her visit. Non-compliance with these Regulations may lead to withdrawal of the access ticket.
9.2. Additionally, it may be that the Customer cannot participate in all sports activities due to applicable safety restrictions (height, age or other conditions as posted in The NXT Fit). The fact that certain sports activities are not accessible to the Customer does not constitute a reason for refund. In case of doubt, the Customer can always contact The NXT Fit in advance for more information about the sports activities and safety restrictions.
10.1. If the Customer has complaints, he/she can contact The NXT Fit via the following email address: info@thenxtfit.com
11.1. The NXT Fit uses the personal data of Customers only in accordance with the privacy policy on the Website: thenxtfit.com/privacy-policy/.
11.2. It is possible that during a visit to the park, during events and other activities at The NXT Fit, photos are taken and/or recordings are made (with cameras other than security cameras). These images will in principle be non-targeted. Only with the consent of the visitor in question will targeted images be taken. For minor visitors, the legal representative must give this consent.
The usage rights of this visual material belong to The NXT Fit BV. By accepting these general terms and conditions, the Customer gives permission to The NXT Fit to use this material without any restriction, including but not limited to making it wholly or partially public and/or reproducing it in all media, including (not limited to) digital communication, print media, POS material, on social media and The NXT Fit website, without further consent or any compensation due.
Visitors who do not want photos/images of them to be used must expressly make this known at the reception before they enter the location on the day of their visit. Such objection will have no impact on the images made by security cameras.
12.1. Dutch law applies to these general terms and conditions. This means that the Agreements for the purchase of Products and all disputes or claims arising from or in connection therewith are governed by Dutch law.
13.1. Without prejudice to the rights and remedies granted to the Customer under applicable law or these general terms and conditions, our liability for foreseeable damage is limited to the value of the ordered Products.
13.2. The invalidity of a provision or part of a provision of the Agreement has no influence whatsoever on the validity of the remaining part of the provision or the rest of the provisions.
